In mid-February, the FAA ARC will publish Terms of Reference describing the work of each of several working groups that will be helping to craft the Part 21 language as well as developing a new paradigm for FAA oversight of systems. The FAA is working to incorporate Safety Management Systems (SMS) elements into the existing Part 21 regulations for design and production. As part of this endeavor, they have asked MARPA to assist them in an Aviation Rulemaking Committee (ARC). The FAA provided us with a briefing on the current status of the Manufacturing SMS Pilot Project, which is now starting. The first participating company is Pratt & Whitney, but eventually up to 12 companies may be participating. The Pilot Project will help the FAA to assess the need for a regulation, and the scope of any regulation that should be implemented. Continue reading

MARPA has filed comments in response to the Japanese proposed rule on Safety Management Systems (SMS). In general, MARPA was pleased with the direction being taken by the Japanese rule. MARPA’s comments suggest areas where the proposed rule can be improved to better match the proposal offered by the International Civil Aviation Organization (ICAO). Just as Comair’s mechanics have chosen to withdraw from the FAA’s ASAP, Congress has passed a law that will require FAA to make a rule requiring air-carrier participation in programs like ASAP. This may pose some implementation challenges as well as some labor-management issues. The upcoming SMS rule may provide an opportunity to improve this system. Click through for the full article. The President signed into law the Airline Safety and Federal Aviation Administration Extension Act of 2010 on August 1. One of the provisions of this new law is a requirement that the FAA publish a notice of proposed rulemaking within 90 days that would impose a requirement for Safety Management Systems (SMS) on air carriers.
