The DC Circuit Court of Appeals has issued a “show-cause” order to the FAA, threatening to suspend the enforceability of the FAA’s drug testing rules. The FAA has until March 10th to file their response. The underlying issue behind the “show-cause” order is the FAA’s failure to perform the Regulatory Flexibility Analysis associated with the application of the drug testing rules to repair stations.
