Just as Comair’s mechanics have chosen to withdraw from the FAA’s ASAP, Congress has passed a law that will require FAA to make a rule requiring air-carrier participation in programs like ASAP. The President signed into law the Airline Safety and Federal Aviation Administration Extension Act of 2010 on August 1. One of the provisions of this new law is a requirement that the FAA publish a notice of proposed rulemaking within 90 days that would impose a requirement for Safety Management Systems (SMS) on air carriers.
